The digital age brings with it novel forms of data flow. As a result, individuals are constantly being monitored while consuming products, services and content. These abilities have given rise to a variety of concerns, which are most often framed using “privacy” and “data protection”-related paradigms. An important, oft-noted yet undertheorized concern is that these dynamics might facilitate the manipulation of subjects; a process in which firms strive to motivate and influence individuals to take specific steps and make particular decisions (...) in a manner considered to be socially unacceptable. That it is important and imperative to battle manipulation carries with it a strong intuitive appeal. Intuition, however, does not always indicate the existence of a sound justification or policy option. For that, a deeper analytic and academic discussion is called for. This Article begins by emphasizing the importance of addressing the manipulation-based argument, which derives from several crucial problems and flaws in the legal and policy setting currently striving to meet the challenges of the digital age. Next, the Article examines whether the manipulation-based concerns are sustainable, or are merely a visceral response to changing technologies which cannot be provided with substantial analytical backing. Here the Article details the reasons for striving to block manipulative conduct and, on the other hand, reasons why legal intervention should be, in the best case, limited. The Article concludes with some general implications of this discussion for the broader themes and future directions of privacy law, while trying to ascertain whether the rise of the manipulation-based discourse will lead to information privacy’s expansion or perhaps its demise. We are currently witnessing a sharp rise in the use of algorithmic decision-making tools. In these instances, a new wave of policy concerns is set forth. This article strives to map out these issues, separating the wheat from the chaff. It aims to provide policy makers and scholars with a comprehensive framework for approaching these thorny issues in their various capacities. To achieve this objective, this article focuses its attention on a general analytical framework, which will be applied to a (...) specific subset of the overall discussion. The analytical framework will reduce the discussion to two dimensions, every one of which addressing two central elements. These four factors call for a distinct discussion, which is at times absent in the existing literature. The two dimensions are the specific and novel problems the process assumedly generates and the specific attributes which exacerbate them. While the problems are articulated in a variety of ways, they most likely could be reduced to two broad categories: efficiency and fairness-based concerns. In the context of this discussion, such problems are usually linked to two salient attributes the algorithmic processes feature—its opaque and automated nature. (shrink)

En este artículo se revisa el lugar que ocupa Eckhart en L’essence de la manifestation, a fin de establecer correspondencias y afini­dades entre el místico renano y la peculiar concepción que de la fenomenología sostiene Michel Henry. Se trata de analizar la es­trecha cercanía entre el alma humana y Dios postulada por Meister Eckhart y su vinculación con la conocida noción de Vida presente en el autor francés. Henry es proclive a fundar una filosofía primera asociada a la pura autoafección, (...) describiendo la Vida sea como pura inmanencia, sea como una ipseidad algo problemática. En general, el trabajo teórico de los representantes del “giro teológico de la fenomenología francesa” (Janicaud) cuestiona al sujeto clásico de la Modernidad, sin por eso traer a colación la causa de un Dios Revelado ni el que resulta de una teología natural. Este trabajo, en suma, no es el esfuerzo de pensar a un Dios confesional ni tiene un propósito evangélico. Lejos de ello, se trata de precisar el nexo entre Henry y Eckhart, puesto en escena por aquél, y si tal nexo es coherente con lo que Henry piensa acerca de un modo de manifestación que ya no implica distancia fenomenológica alguna: la manifestación del pathos de la Vida. En este artículo se establece un análisis histórico, axiológico y epistemológico de las condiciones de advenimiento de una filosofía médica abocada al estudio de la enfermedad. El examen de estas condiciones toma en cuenta los estudios clásicos y contemporáneos de la filosofía de la medicina, analizando sus distintas perspectivas y enunciados. La reflexión en torno de los supuestos y conceptos asociados a tal tipo de filosofía, localiza la enfermedad en sus distintas dimensiones: en el ámbito del acontecimiento biológico (disease), del (...) orden social (sickness), y de la experiencia vivida (illness). Tres puntos de deliberación presentan el cuerpo nodular de estos análisis: a) la constitución disciplinaria y conceptual de la enfermedad como un hecho total: variantes epistemológicas de la medicina y la filosofía antigua; b) la psicopatología en la constitución de una filosofía de la enfermedad, el análisis epistemológico de dos conceptos: normal-patológico; y c) la filosofía de la vida de G. The question of whether conscious experience is restricted by cognitive access and exhausted by report, or whether it overflows it—comprising more information than can be reported—is hotly debated. Recently, we provided evidence in favor of Overflow, showing that observers discriminated the color‐diversity (CD) of letters in an array, while their working‐memory and attention were dedicated to encoding and reporting a set of cued letters. An alternative interpretation is that CD‐discriminations do not entail conscious experience of the underlying colors. En su último trabajo el historiador Enzo Traverso afirma que las utopías del siglo XX han desaparecido dejando un presente cargado de memoria pero impotente a la hora de proyectarse en el futuro (Traverso, 2018: 34). La era actual del presentismo histórico, tal como lo denomina François Hartog, momifica toda experiencia pasada despojando el potencial revolucionario y, a su vez, anulando la posibilidad de un futuro emancipador ante la inmanencia de lo mismo. Esa fuerza histórica totalitaria se nos presenta como (...) un continuo inanimado carente de toda narración histórica. La historiografía dominante es producto de la adición de relatos inconexos, tanto que el principio de rekonstruktion actualiza el pasado en consonancia a la legitimación de los vencedores. Ante ello, la melancolía de izquierda es un ejercicio que busca “repensar un proyecto revolucionario en una era no revolucionaria” (Traverso, 2018: 55). En la melancolía, a diferencia del duelo, “el sujeto mantiene su fidelidad al objeto perdido, negándose a renunciar a su vínculo con él” (Žižek, 2019: 63). La cultura de la derrota recolectó las huellas del pasado sepultado y es ahora, en un presente uniforme, donde intenta recuperar del olvido aquel proyecto concluido de forma catastrófica. El objetivo del presente trabajo es repensar y construir el pasado a la luz de la recuperación de aquello que no ha acontecido. Recolectar los fragmentos inacabados por intermedio del principio de konstruktion es también dar un haz de luz a la potencia suspensiva del tiempo presente. (shrink)

En este artículo de investigación se muestra, que durante la fabricación de hierro, las escorias han sido una fuente información del producto obtenido. Esto aplica a toda la historia de la fabricación de este metal desde el inicio de la edad del hierro. Los estudios en este campo se conocen como arqueo de metalurgia y se inicia desde la paleo metalurgia hasta el presente. Las escorias primitivas obtenidas a partir de su separación de la masa de hierro sólida obtenidas en (...) procesos muy primitivos y más modernas como la forja catalana. Estudios petrográficos, de difracción de rayos X y de fluorescencia de rayos x, han revelado la existencia fayalita, en escorias siderometalúrgicas antigüas a temperaturas por debajo del punto eutéctico,deducidas como entre 1150°C y 1200°C. Más recientemente, la presencia de fayalita ha sido revelada en procesos de reducción operando con temperaturas menores a los 900°C. En este documento se presenta una explicación para tal hecho mediante un análisis de las energías asociadas a los sistemas. Cerámicos compuestos de FeO- SiO2-MgO- P2O5 presentes en dichos procesos. Quinn offered seven definitions of “cladist” and discussed the context in which they are used in relation to historical and current debates in systematics. As a member of her study taxon, I offer some contextual color commentary, clarifications on the views of “pattern cladists” regarding monophyly, ancestors, synapomorphy and other concepts, a definition of “syncretist”, and some thoughts on cladistics and philosophy in the twenty first century.

As researchers interested in social aspects of sport, we enmesh ourselves in the work of memory, (re)membering and forms of ‘capturing’ sport and sport experiences. While nostalgia is at play in these social constructions of sport, for researchers we contend that the concept of nostalgia can prove devious. In this paper, we illustrate the social significance afforded to nostalgic experiences or events, and consider their representation in social sciences sport research. We develop and apply arguments concerning the senses, nostalgia, and (...) language in line with the ‘abilities’ view of concepts. The consequences of nostalgia can, we contend, be underplayed, taken for granted and/or ignored by sport researchers in ways that curtail more critical readings of sport phenomena. Our purpose is to interrogate the construction and a/effects of nostalgia as hidden/implicit/latent and heuristic. We advocate methodological critique that addresses the elusive, apparent, ‘capturable’ and confusing nature of nostalgia within sport research. (shrink)

ABSTRACT While philosophers have highlighted important reasons to resist one’s own oppression, they tend to overlook the phenomenon of complacency about one’s own oppression. This article addresses this gap by arguing that some oppressed agents are obligated to resist complacency about their own oppression because failing to do so would significantly harm themselves and others. Complacent members of oppressed groups fail to resist meaningfully, are self-satisfied, and are epistemically culpable. I contend that focusing on the obligation to combat complacency is (...) useful for at least two reasons. First, complacency about one’s own oppression is a distinctive phenomenon that warrants separate philosophical attention. Second, focusing on the obligation to resist complacency helps analyze an undertheorized group of oppressed agents by challenging the binary understanding of power prevalent in the literature on the duty to resist, thereby sharpening philosophical accounts of resistance and filling a gap in a prominent well-being-based theory of resistance. Lead (Pb) contamination of the environment is an important human health problem. Children are vulnerable to Pb toxicity; it causes damage to the central nervous system and, in some extreme cases, can cause death. Lead is widespread, especially in the urban environment, and is present in the atmosphere, soil, water and food. Pb tends to accumulate in surface soil because of its low solubility, mobility, and relative freedom from microbial degradation of this element in the soil. Lead is present in (...) soil as a result to weathering and other pedogenic processes acting on the soil parent material; or from pollution arising caused by the anthropogenic activities; such as mining, smelting and waste disposal; or through the adoption of the unsafe and unethical agricultural practices such as using of sewage sludge, and waste water in production of vegetable crops or cultivation of vegetables near highways and industry regions. Lead concentrations are generally higher in the leafy vegetables than the other vegetables. Factors affecting lead uptake included its concentration in the soil, soil pH, soil type, organic matter content, plant species, and unsafe agriculture practices. Generally, as Pb concentration increased; dry matter yields of roots, stems and leaves as well as total yield decreased. The mechanism of growth inhibition by lead involve: a decrease in number of dividing cells, a reduction on chlorophyll synthesis, induced water stress to plants, and decreased NO 3 - uptake, reduced nitrate and nitrite reductase activity, a direct effect of lead on protein synthesis, a decrease on the uptake and concentration of nutrients in plants. The strategies to minimize Pb hazard can be represented in: (a) Phytoremediation, through natural plants are able to bio-accumulate Pb in their above–ground parts, which are then harvested for removal such as, using Indian Mustard (Brassica juncea), Ragweed (Ambrosia artemisiifolia), Hemp Dogbane (Apocynum cannabium), or Poplar trees, which sequester lead in its biomass. (b) Good and ethical agricultural practices such as cultivation of vegetables crops as far from busy streets or highways and industry regions as well as nonuse of sewage sludge and waste water in cultivated soils. (c) Increasing the absorptive capacity of the soil by adding organic matter and humic acid. (d) Growing vegetable crops and cultivars with a low potential to accumulate lead, especially in soils exposed to atmospheric pollution. (e) Washing of leafy vegetables by water containing 1 % vinegar or peeling roots, tubers, and some fruits of vegetables before consumption may be an important factor in reducing the lead concentration. Sadler, MD (bio)Back in 2011, I wrote a paper for the Journal of Bioethical Inquiry, an Australian journal, for a special issue dedicated to ethical issues associated with psychiatric genetics research. The editor was particularly excited by the recent findings of the 5-HTT allele in psychiatric illness. I had different ideas about what I wanted to write about, and the editor, Michael Robertson, (...) graciously considered them and ultimately published the paper. At the time I was interested in the colossal investment of National Institutes of Mental Health (NIMH) research dollars in psychiatric genetic research; at the time I was troubled at the lack of on-the-ground clinical implications of this research investment, and figured an Australian journal and referees would be more generous to a critical paper on U.S. funding priorities. I dug into the National Institutes of Health (NIH), NIMH, and National Science Foundation websites and found some crude dollar evidence of respective expenditures for research funding in various disorders and focus areas, and compared these investments to psychiatric genetic research funding commitments. I will not go into details (Sadler, 2011), but the gist was that the psychiatric genetics research enterprise was and had been an extraordinarily expensive enterprise, when other research questions that could be immediately implementable into clinical care improvements remained marginally funded at best. The paper was not read widely and other than a couple of annoyed responses from psychiatric genetic researchers, not much came of it.This concern about funding priorities was one of the reasons why I was pleased to see this paper by Turkheimer and Greer which explores the long term results of the Spit for Science (S4S) initiative, which was launched grandly the same year as my paper’s whisper from down under. I hope this Philosophical Case Conference explores the many dimensions of interest for this paper, which is extraordinarily careful and even handed in its attitude, while at the same time being incisive in its analysis.My focus here is not in the science per se, which is beyond my competence. I’m interested in Turkheimer and Greer’s (T&G) conceptual overview of this research program. More specifically, I focus on T&G’s highlighting of the extraordinary willingness of the S4S authors to interpret prevailingly negative results in the most generous, even misleading, degree possible. I try to provide some possible ways of understanding this kind of research rhetoric exhibited by a cohort of highly respected, very successful scientists.I acknowledge the well-described varieties of interpretive bias that all of us are subject to. First on the list must be confirmation bias, our tendency to interpret situations in terms consistent [End Page 447] with our preconceived notions—in this case, the idea that genetics has something important to do with addictive disorders. Another might be epistemic overconfidence—the tendency to fail at interpretive skepticism in favor of one’s preferred conclusion. Related to this may also be interpretive momentum, the tendency to maintain a conviction about the correctness of one’s expectations and disregard inconsistent findings over the course of a research program—in this case, the multiple S4S studies (O’Sullivan & Schofeld, 2018). However, these kinds of biases tend to “blame” the individual authors’ thinking styles. I opine, though, that other vectors shaping the declaring-success rhetoric are more important.These sources have to do with the state of practice in doing biomedical science research in universities and particularly academic medical centers (AMCs) today. I identify several causal vectors that compel, however subtly, researchers to declare success in the face of failure. I have only picked three, and in no order of importance: 1) funding caps for NIH grants, 2) the overleveraging of university budgets and ballooning dependence on soft money, and 3) the incentivizing of intellectual property development within AMCs.Funding Caps for NIH GrantsIf you are a university or AMC, one way you hold onto your most productive scientists (e.g., grants, publications, discoveries, and status) is by paying them well.
